These Terms govern all sales by Fortis Labs and all use of this website. By placing an order or using this site, you accept them in full.
Products supplied by Fortis Labs are chemical reference materials intended solely for in vitro laboratory research. They are not drugs, biologics, medical devices, foods, cosmetics, dietary supplements, or consumer products.
No product has been evaluated or approved by the U.S. Food and Drug Administration or any comparable authority for the diagnosis, treatment, cure, mitigation, or prevention of any condition in humans or animals. Certain items in the catalog are investigational compounds with no approved use in any jurisdiction.
We make no representation that any product is safe or effective for any purpose. Nothing on this site, in any document we issue, or said by any employee or representative is a therapeutic, diagnostic, preventive, performance, cosmetic, or health claim. Any such statement, if made, is unauthorised and void.
Products are not for human or veterinary use and must not be administered to, ingested by, injected into, or applied to any human being or animal.
We sell only to laboratories, research institutions, universities, and commercial research entities acting through qualified personnel. Before releasing any order we may require verification of the institution and a business address, a signed Research Use Agreement, and a description of the intended in vitro application.
We do not ship to residential addresses, PO boxes, or mail-forwarding services. We decline orders at our sole discretion, without explanation and without liability.
Any request that indicates intended human or veterinary use will be refused and the account closed. This includes requests for dosing or administration guidance and requests for injection supplies.
We do not sell, bundle, recommend, or ship syringes, needles, bacteriostatic water, sterile water for injection, or any administration equipment. We do not publish or provide dosing schedules, dose calculations, titration guidance, administration routes, cycling protocols, or reconstitution instructions for use in a living subject, through any channel.
By ordering, you represent, warrant, and covenant that:
Prices are per vial in U.S. dollars, exclusive of shipping, insurance, duties, and taxes, and may change without notice.
An order submitted through this site is an offer to purchase. No contract is formed until we confirm it in writing and release it for shipment. We may decline any order after payment, in which case we refund in full. Obvious errors in price or description may be corrected at any time, including after an order is placed; where a corrected price is higher, you may cancel for a full refund.
You are responsible for all applicable taxes, duties, and customs charges.

We warrant solely that, at the time of shipment, each product conforms to the analytical specification stated on its lot certificate of analysis. This is the only warranty we give.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT — ARE DISCLAIMED. We do not warrant that any product is suitable for any particular assay or application; determining suitability is solely your responsibility.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTIS LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE, DATA, RESEARCH, OR BUSINESS OPPORTUNITY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
WE EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY INJURY, ILLNESS, DISABILITY, OR DEATH ARISING FROM ANY USE OF THE PRODUCTS OTHER THAN IN VITRO LABORATORY RESEARCH, INCLUDING ANY ADMINISTRATION TO A HUMAN BEING OR ANIMAL, WHETHER BY YOU OR ANY THIRD PARTY, AND WHETHER OR NOT FORESEEABLE.
You will indemnify, defend, and hold harmless Fortis Labs and its officers, directors, members, employees, agents, and affiliates from all claims, demands, actions, investigations, proceedings, damages, judgments, settlements, fines, penalties, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your breach of these Terms; any administration of products to any human or animal; any resale, transfer, repackaging, or compounding; any representation you make about the products; your violation of any law; or any injury, illness, or death alleged to result from the products after delivery.
This obligation survives termination.
Access to the catalog requires the confirmation shown on entry. Submitting that confirmation falsely is a breach of these Terms and may constitute fraud; we record confirmations and associate them with orders.
You must not scrape or systematically extract site content, interfere with or probe the site, introduce harmful code, or republish our content, certificates, or imagery without written permission. The Fortis name, logo, "F" mark, product imagery, and the tagline "Engineering Human Performance" are our property.
THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
You will not export, re-export, or transfer any product in violation of U.S. export control or sanctions law. We keep records of verification, confirmations, and orders, and may disclose them to regulatory or law enforcement authorities where required by law or where we reasonably believe disclosure is necessary. We may report communications indicating intended human use or unlawful conduct.
Governing law. Texas law governs, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
Venue. The state and federal courts of Dallas County, Texas have exclusive jurisdiction.
Entire agreement. These Terms, with the Research Use Agreement and any order confirmation, are the entire agreement and supersede all prior discussions. Purchase order terms you issue are rejected.
Severability. Any unenforceable provision is modified to the minimum extent necessary or severed; the rest continues in force.
Amendment. We may amend these Terms by posting an updated version. The version in effect when you order governs that order.
Assignment. You may not assign these Terms without our written consent.
Survival. Sections 1, 3, 4, 7, 8, 9, 11, and 12 survive termination.
